Blizzcool general booking and rental conditions
We recommend that you read these General Booking and Rental Conditions carefully, as they govern the booking, contracting, delivery, use, return and other conditions applicable to the rental of Blizzcool equipment.
The purpose of these conditions is to let the customer know what to expect from Blizzcool, what information is needed to organise the rental properly, and what obligations are assumed by both parties.
Blizzcool bookings and rental contracts will be formalised solely in Spanish.
Bookings for Blizzcool equipment will be made by telephone, in accordance with the commercial information set out in the promotional leaflet handed to the customer, without prejudice to Blizzcool confirming or documenting the booking by email, written message, contract, delivery note or any other equivalent means.
1. Acceptance of the conditions
Formalising the booking implies the customer’s express acceptance of these General Booking and Rental Conditions, as well as of the financial and commercial conditions communicated by Blizzcool at the time of contracting.
Blizzcool may ask the customer to accept these conditions by handwritten signature, electronic signature, email, written message, telephone confirmation, delivery note or any other means that evidences their agreement.
The natural or legal person named as the holder of the booking will be responsible for full compliance with the obligations arising from the rental, even if the equipment is used by employees, collaborators, family members, guests, third parties or staff authorised by the customer.
2. Booking and contracting process
Step one:
The customer must contact Blizzcool by telephone to request information about the equipment they wish to rent, stating their requirements, location, planned rental start date and estimated duration.
Step two:
Blizzcool will inform the customer of the availability of the requested equipment, the rental conditions, the applicable minimum duration, the rental price, the cost of transport and, where applicable, any other additional charge that may apply.
Step three:
The customer must provide the personal or company details needed to process the booking and prepare the rental contract, including tax details, delivery address, contact details and any other information required for the proper provision of the service.
Step four:
The conditions for delivery and collection of the equipment will be agreed. Transport is not included in the rental price. For deliveries within mainland Spain, a fixed charge of €100 will be applied for standard transport, unless otherwise agreed in writing.
Step five:
The booking will be subject to confirmation by Blizzcool, depending on the actual availability of the equipment at that time and on the customer’s acceptance of the conditions.
Step six:
Once the booking has been confirmed, Blizzcool may ask the customer for the necessary documentation, as well as the payment, down payment, security deposit, deposit or any other amount applicable before the start of the rental.
3. Booking confirmation
A booking request does not in itself constitute a definitive rental contract. The contract will only be concluded when Blizzcool expressly confirms the availability of the equipment, the customer accepts the financial conditions and the required documentation, payment, security deposit or deposit requirements have been met.
The booking will not be considered confirmed until Blizzcool expressly informs the customer of the availability of the equipment and the acceptance of the rental request.
Blizzcool reserves the right not to confirm a booking when no equipment is available, when delivery cannot be made under the requested conditions, when the customer does not provide the required documentation, when the requested payments are not made or when there are reasons that prevent the proper provision of the service.
All bookings are subject to the actual availability of equipment at the time of confirmation. Blizzcool will not be liable for any inability to supply arising from lack of availability, a prior breakdown, late return by another customer, force majeure or any cause beyond Blizzcool’s reasonable control.
4. Minimum rental period
The minimum rental period is 1 month.
Any rental contracted for a period of less than one month will still be invoiced as a full month, unless expressly agreed otherwise in writing between Blizzcool and the customer.
Promotions, special rates or conditions included in the promotional leaflet may be subject to specific conditions, which the customer must check and accept before confirming the booking.
5. Rates and included items
The rental price will include only the items expressly stated in the offer, promotional leaflet, contract, quote or commercial communication provided by Blizzcool.
Unless otherwise stated, transport, installation, removal, out-of-hours assistance, consumables, adapters, extension leads, special sockets, electrical adaptations, damage, misuse or any other additional service will not be included in the basic rental rate.
Transport to mainland Spain will have a fixed charge of €100, unless other conditions are agreed in writing.
This amount covers standard transport under normal access conditions. Special services are excluded, such as urgent deliveries, special time slots, second deliveries, difficult access, absence of the customer, exceptional manual handling, use of auxiliary equipment, restricted areas or any circumstance not initially foreseen.
Blizzcool may require a guarantee, security deposit or deposit before delivering the equipment. This security deposit will cover, among other things, possible damage, late returns, loss, robbery, theft, misuse, failure to return, exceptional cleaning, accessories not returned or any breach of the obligations assumed by the customer.
The security deposit will not limit the customer’s liability in the event of damage, loss, robbery, theft, disappearance, deterioration, tampering, misuse or failure to return the rented equipment.
The guarantee or security deposit will be refunded once the rental has ended, the equipment has been returned, its condition has been checked and it has been verified that there are no outstanding amounts or unfulfilled obligations on the part of the customer.
6. Payment method, deposit and non-payment
Blizzcool will inform the customer of the available payment methods at the time of booking.
The customer must pay the agreed amounts within the periods indicated by Blizzcool. Total or partial non-payment of any amount may result in cancellation of the booking, suspension of the service or termination of the contract.
If a security deposit or deposit is requested, it must be paid before delivery of the equipment, unless expressly agreed otherwise in writing.
Total or partial non-payment of any invoice, instalment, security deposit, transport, repair, penalty or amount owed will entitle Blizzcool to suspend the service, terminate the contract, demand the immediate return of the equipment and claim the outstanding amounts, interest, collection costs, transport costs and any damages caused.
7. Customer documentation and conditions
Blizzcool may ask the customer for the documentation needed to formalise the rental, including, among others, national ID card (DNI), foreigner identity number (NIE), tax identification number (CIF), tax details, delivery address, contact details and any other information needed to verify the identity of the contracting party or the requesting company.
The customer declares that the details provided are true, accurate and up to date.
If the details are incorrect, incomplete, false or cannot be verified, Blizzcool may reject the booking, cancel the contract or not proceed with delivery of the equipment.
The rented equipment must be used solely for its intended purpose and in accordance with the instructions provided by Blizzcool.
The customer will be responsible for the proper use, care and safekeeping of the equipment throughout the rental period.
8. Delivery and collection of the equipment
The equipment will be delivered and collected at the address agreed with the customer.
Transport is not included in the rental price. For deliveries within mainland Spain a fixed charge of €100 will apply, unless otherwise agreed in writing.
The customer must provide a correct, accessible and suitable address for the delivery and collection of the equipment.
If delivery cannot be made for reasons attributable to the customer, Blizzcool may pass on the costs arising from a new delivery, travel, waiting time, handling or any other additional expense incurred.
The customer must inspect the equipment at the time of delivery. Signing the delivery note, contract, delivery document or equivalent acceptance will imply receipt of the equipment in apparently correct working order and condition, unless any issues are recorded in writing at that same moment.
Any issue detected after delivery must be reported to Blizzcool within a maximum of 24 hours of receiving the equipment.
If, on the date agreed for collection, the equipment is not available, accessible, disconnected or ready for removal for reasons attributable to the customer, Blizzcool may invoice a new trip, as well as the additional rental days until the equipment is actually recovered.
9. Installation, location and conditions of the space
The customer will be responsible for providing a suitable location for the equipment to operate, including sufficient space, ventilation, a compatible power supply, a stable surface, protection from rain or external agents where appropriate, and any other necessary technical conditions.
Blizzcool will not be liable for any lack of performance, breakdowns, damage or service interruptions arising from improper installation, use in non-recommended conditions, insufficient electrical supply, unauthorised tampering or failure to follow the instructions provided.
Unless expressly agreed otherwise in writing, the electricity supply, energy consumption, adapters, extension leads, special sockets or any adaptation of the customer’s installation will not be included in the rental price and will be the sole responsibility of the customer.
10. Use, care and customer liability
The customer undertakes to use the rented equipment properly, diligently and in accordance with the instructions for use provided.
From the moment of delivery until the equipment is actually returned to Blizzcool, the customer will be responsible for its safekeeping, care and proper use.
The customer will be liable for any damage, loss, robbery, theft, disappearance, deterioration, tampering, misuse or failure to return the equipment, even if a security deposit or deposit has been paid.
The security deposit does not limit the customer’s liability, which may extend to the full cost of repair, replacement, transport, substitution, cleaning, loss of accessories, loss of profit and any other expense arising from the breach.
The customer may not assign, lend, sublet, sell, move or make the equipment available to third parties without Blizzcool’s prior written authorisation.
The equipment must remain at the agreed location, unless expressly authorised by Blizzcool.
Opening, tampering with, repairing, modifying, dismantling, moving without authorisation or carrying out any technical work on the equipment by the customer or by third parties unrelated to Blizzcool is prohibited.
Any unauthorised tampering may result in the loss of warranties, the obligation to pay for the damage caused and early termination of the rental.
11. Equipment performance
Blizzcool guarantees the delivery of equipment in correct working order, but does not guarantee that a specific temperature will be achieved when performance depends on external factors such as the size of the space, insulation, ventilation, sun exposure, outdoor temperature, number of people, heat sources, doors being opened, the electrical installation, the location of the equipment or improper use.
The customer acknowledges that equipment performance may vary depending on the ambient conditions, the use made of it and the characteristics of the space where it is installed.
12. Changes, modifications and cancellations
Any modification to the booking must be requested from Blizzcool by telephone and will be subject to availability.
Cancellations must be notified as far in advance as possible. Blizzcool may charge cancellation fees if the booking has already been confirmed, prepared or dispatched, or if costs associated with it have been incurred.
In the event of cancellation once the rental has started, a refund of the amounts corresponding to the minimum contracted period is not guaranteed.
Any extension or renewal of the rental must be requested before the planned end date and will be subject to acceptance by Blizzcool.
If the equipment continues to be used without express authorisation, Blizzcool may invoice the corresponding additional period, without prejudice to demanding the immediate return of the equipment.
13. Late return
If the customer does not return the equipment on the agreed date, the rental will be deemed automatically extended for full monthly periods, unless otherwise agreed in writing.
Blizzcool may invoice the additional periods, as well as the costs of failed collection, travel, handling, penalties or damages caused by the late return.
Failure to return the equipment will entitle Blizzcool to demand its immediate recovery, as well as the outstanding amounts, damages, handling costs, transport costs and any other amount arising from the breach.
14. Cleaning, accessories and return of the equipment
The equipment must be returned in good working order, clean and in good condition, together with all its accessories, cables, remote controls, packaging, manuals or other items delivered.
Failure to return any accessory, or returning the equipment in poor condition, exceptionally dirty or damaged, may give rise to additional charges.
Blizzcool may deduct from the security deposit, claim or invoice the customer for the amounts corresponding to exceptional cleaning, repair, replacement of parts, accessories not returned, damage, additional transport or any other expense arising from the condition in which the equipment is returned.
15. Unavailability of the booked equipment
If, once the booking has been confirmed, Blizzcool is unable to provide the booked equipment due to availability, breakdown, force majeure or other circumstances beyond its control, it may offer the customer a similar alternative, provided one is available.
If the customer does not accept the proposed alternative and it is not possible to supply the equipment originally booked, Blizzcool will, where applicable, cancel the booking and refund the amounts paid for services not provided.
Blizzcool will not be liable for indirect damages, loss of profits, loss of business, business interruptions, cancelled events, affected goods or any other indirect financial loss arising from the inability to supply, except where the law imposes mandatory liability.
16. Technical assistance
Blizzcool will provide technical assistance in the event of an issue or breakdown of the equipment during the rental period, always within the agreed conditions and the available service hours.
Technical assistance may not be included in cases of misuse, unauthorised tampering, damage caused by the customer, issues arising from the customer’s installation, insufficient electrical supply, unsuitable ambient conditions or causes external to the equipment.
If the customer requires special, urgent or out-of-hours assistance, they must check with Blizzcool in advance, and it may be subject to availability and additional costs.
17. Limitation of Blizzcool’s liability
Blizzcool will not be liable for loss of business, loss of profits, business interruptions, indirect damages, loss of earnings, loss of goods, food, products, events, reservations, sales or any indirect financial loss arising from the use, breakdown, delay, lack of performance or unavailability of the equipment, except where the law imposes mandatory liability.
Blizzcool will be liable only on the terms provided for by the applicable legislation and by the conditions expressly accepted between the parties.
18. Leaflets, images and promotional material
The images, photographs, descriptions, features, dimensions and characteristics shown in leaflets, catalogues, commercial communications or promotional material are for information and guidance only, unless they are expressly incorporated into the rental contract.
Blizzcool may supply equivalent equipment or equipment with similar features when the specific model is not available, provided it is suitable for the contracted purpose.
Promotions, discounts or special conditions shown in leaflets or promotional campaigns will be subject to availability, duration, specific conditions and prior acceptance by Blizzcool.
19. Communications between the parties
Communications between Blizzcool and the customer may take place by telephone, email, SMS, WhatsApp or other means provided by the customer.
The customer accepts that communications made through these means are valid for the purposes of managing the booking, confirmation, modification, issues, payments, delivery, collection and claims.
The customer will be responsible for providing correct and up-to-date contact details. Blizzcool will not be liable for issues arising from incorrect, incomplete or outdated details provided by the customer.
20. Force majeure
Neither party will be liable for failure to fulfil its obligations when this is due to force majeure, understood as unforeseeable or unavoidable events beyond the control of the parties that prevent the normal performance of the contract.
Force majeure includes, among others, extreme weather events, fires, floods, administrative restrictions, strikes, supply outages, logistical problems beyond Blizzcool’s control, accidents, epidemics, pandemics, conflicts, unforeseeable breakdowns or any other circumstance that prevents or seriously hinders the provision of the service.
In such cases, Blizzcool may cancel, modify or postpone the provision of the service, informing the customer as soon as possible.
21. Data protection
The personal data provided by the customer will be processed by Blizzcool for the purpose of managing the booking, formalising the rental, providing the service, issuing invoices, answering enquiries, managing payments and complying with legal obligations.
The customer may exercise their rights of access, rectification, erasure, objection, restriction and portability through the contact channels provided by Blizzcool.
Data will be processed in accordance with the regulations in force on the protection of personal data.
22. Business customers and consumers
Unless expressly stated otherwise, the Blizzcool rental service is aimed at business customers, companies, self-employed professionals, event organisers and users who need temporary air conditioning or cooling equipment.
Where the customer acts as a consumer, the rights granted to them by current consumer and user legislation will apply.
Where the customer acts as a business, self-employed person or professional, they acknowledge that the rental is carried out within the scope of their business or professional activity.
23. Governing law and jurisdiction
Spanish law will apply to any dispute arising from the interpretation or performance of the contract.
Where the customer is a business or professional, the parties expressly submit to the Courts and Tribunals of Blizzcool’s registered address, waiving any other jurisdiction that may correspond to them.
Where the customer is a consumer, the competent jurisdiction will be that determined by the applicable regulations.
24. Requests for information or enquiries
To request further information about a booking, rental conditions, equipment availability or any other enquiry, the customer must contact Blizzcool by telephone on the number shown in the promotional leaflet handed to them.
